Italy is both hospitable and inhospitable to shareholder claims. On the one hand, courts seem to value private enforcement and there have been many decisions giving guidance on claims' elements with outcomes favorable to investors. This makes the country a good place for recoveries.
On the other hand, in 2018, a decision by the Court of Milan on standing - setting an unreasonable threshold for proof of share ownership - threatens to block future cases if not reversed on appeal. In the short term, that decision has deterred some case organizers from pursuing collective actions.
